MONTGOMERY, Alabama  — The leader of the Alabama Supreme Court says the state’s court system can’t operate on the $138.9 million allocated to them in budgets that have passed the Alabama House and Senate.

Chief Justice Sue Bell Cobb wouldn’t rule out the possibility that the state’s judges might go to court to force the Legislature to increase funding for the judicial system. She said at a news conference Tuesday that going to court is an option because the Alabama Constitution requires “adequate” funding of courts.

She said a decision to go to court would have to be made by all nine Supreme Court justices. She said taking the Legislature to court would not be her preference.

Cobb said she discussed the funding crisis with the state’s judges and circuit clerks on Monday.
