BAY MINETTE, Alabama — An Atmore man who police say pulled a sawed-off shotgun on his mother-in-law late last year and planned to kidnap his estranged wife has waived his arraignment on firearms and attempted kidnapping charges.
Attorney James Pittman Jr. filed the waiver Wednesday in Baldwin County Circuit Court on behalf of Troy Avery Barton, 46, and entered Barton’s not guilty plea, records show. Barton had been scheduled to be arraigned this week on charges of reckless endangerment and first-degree unlawful imprisonment along with attempted kidnapping and possession of a saw-off shotgun.
According to testimony at a February hearing, Barton went to the Bay Minette-area home of his mother-in-law in December with the weapon, a pillow case, duct tape and zip ties in a duffel bag.
Police said he planned to restrain his in-laws, then take his wife, Tammy Barton, away in hopes of talking her into a reconciliation, but his wife was not at the home.
During a scuffle with a man authorities described as Tammy Barton’s boyfriend, the gun fired but no one was injured by the blast, according to testimony.
Barton remained in the Baldwin County Corrections Center as of Friday with his bail totaling, $525,000, jail records showed.
