The Jefferson County Commission approved a proposed settlement today that is expected to open the way for taxpayer refunds of occupational taxes paid during part of 2009.

The settlement proposal next goes to Circuit Judge David Rains for preliminary approval in a hearing set for Wednesday morning.

The settlement plan calls for workers to automatically get pro-rata refunds of some $31.3 million in occupational taxes the county collected between Jan. 12, 2009 and Aug. 14, 2009. Some $9.4 million in attorney fees would be deducted from that refund pool.

The remaining $6.5 million in tax collections during that period would be the subject of the settlement of the 2007 suit that led Rains to strike down the occupational tax and a related business license fee in 2009.

Workers can accept their share of that refund pool — and run the risk of the county imposing a retroactive tax covering the entire refund period in 2009. Or they can decline the money — which would go to the county — in exchange for a promise by the county it would not seek a retroactive tax against them.
