Jurors in the capital murder trial of a man accused of killing a Pelham police officer were shown a video today that was recorded around midnight Dec. 3, 2009, on Interstate 65.

In the audio of the tape, Officer Philip Davis can be heard telling Bart Wayne Johnson he had stopped him for speeding, asking him if he has his driver’s license, and whether the car belongs to him.

Johnson replies that, no, he just stole it.

“I’m glad you’re in a jovial mood,” Davis says.

Davis is heard saying he asked that queston because sometimes when people borrow somone’s car, they don’t know where the proof of insurance is. Davis can be heard saying, “I’ll be right back.”

Traffic can be heard in the background. Davis returns to the car. There is an inaudible portion of the tape. At some point during the conversion between the two, Davis asks Johnson where he worked, and according to prosecutors, Johnson did not tell him.

On the tape, Johnson can be heard telling Davis that Johnson’s brother is a cop. Davis responded that now Johnson wanted to start acting reasonable.

Davis told Johnson to have his brother call him, and that he would tell him how Johnson acted toward him, “and we’ll see how that works out.”

Davis is not heard again.

Voices can be heard, sirens, and officers talking to Davis, telling him “come on baby, come on man” and telling him to hang on.

After an inaudible portion of the tape, it goes goes silent.

Family members and friends of both Davis and Johnson could be seen crying in the courtroom when the lights came on.

The trial broke for lunch and will resume at 1:45 today.
